Making a head injury claim: FAQs

Can I make a head injury claim?

As with every type of injury claim, to obtain compensation for a head injury, you have to show that it was caused by someone else’s negligence. However, the accident does not need to be 100% the other party’s fault. A head injury compensation claim may still be made even if the victim was partly to blame for the accident. It is never too early to ask for professional advice from a specialist head injury solicitor- we are always happy to talk to you and give you an initial opinion about a possible claim, and it will be entirely free of charge.

If you or someone close to you has suffered a head injury and you need some help about what to do, please ring us on freephone 0808 139 1598 or send an enquiry via our contact form.

 Why choose us?

Not only do we have an excellent track record of success, but we are recommended by the independent legal directory, the Legal 500. In addition we have Lexcel accreditation from the Law Society for excellence in client care.

How long will a head injury claim take?

There is no set time that a head injury claim takes. It all depends on the circumstances of the accident, the severity of the head injury and the impact of the injuries on the victim’s life.

We know that people tend to want their compensation claim concluded as quickly as possible and we obviously do everything we can to speed up the process. However it can be dangerous to rush into a settlement that you may regret at a later date. Remember that any settlement is invariably ‘full and final’. This means that you have just one opportunity to get it right ,and you cannot return for a second bite of the cherry if it later turns out that the figure you agreed is not sufficient.

It is especially important to bear in mind that the full extent of a head injury may not be apparent for quite some time after the accident. It is therefore sensible to allow time for the head injury to settle down before drawing any firm conclusions about what impact it will have on your life.

We appreciate that for the victim and their family, concerns about the time the case will take can often really be a reflection of money worries, especially if the injury means you are off work and lose earnings. We can therefore help ease your financial troubles by obtaining an ‘interim payment’ which is an upfront sum of compensation that is paid while the claim is progressing.

Will I have to pay any legal costs upfront?

In a word, no. We work on a “No Win, No Fee” basis and will fund all case expenses such as medical reports and court fees. Click here for more details.
